New Review Comment on 09/06/2022: The original review done on 08/08/2022 had no site plan uploaded yet to this permit when I completed my review, the site plan provided shows this addition roof actually crossing the physical property line into the neighbors yard, this cannot be approved as constructed today as we are not allowed to have buildings or structures cross the property line. We could entertain a No-Build Easement if the neighboring property owner were to execute an agreement with the applicant to allow this, or we could approve the roof being cut back so it were to remain on the applicants property without crossing the property line.
Building Code review completed and approved with snow removal agreement form being provided, a past owner constructed this addition without a permit, the roof rafters were no meeting 50psf snow load so owners agreed to remove snow. Modify proposal to meet MDR (Medium Density Residential) zone district setbacks (15' front/rear, 10' side) or request a Variance. Under no circumstances can a Variance be granted beyond 0' to encroach onto someone else's property or onto the right-of-way.
This addition was constructed around 2004 to 2005 range without a permit by previous owner, permit is to bring the addition into compliance. Unclear what portions are existing and what is being permitted on the site plan. No structure appears to meet the MDR zone district setbacks (15' front/rear, 10' side) and buildings appear to go over the property lines onto other properties and into the right-of-way. A Variance application will likely be needed unless the applicant wishes to modify the structures to meet setbacks. Under no circumstances can Planning approve a Variance beyond 0' (beyond a property line).
